Carson Man Sentenced to a Combined 16 Years Following Drive-By Shooting

Charges Included Assault with a Deadly Weapon

A Carson City man has been sentenced to 16 years in prison, with eligibility for parole after 6 years, after he pled guilty to committing a drive-by shooting in a residential neighborhood in Sparks. Earlier this month, David Maciel (dob 10/16/02) was given 48-120 months after pleading guilty to Shooting into an Occupied Structure and a consecutive 28-72 months for Assault with Use of a Deadly Weapon.

Last July, officers with the Sparks Police Department were called out to a Sparks neighborhood following multiple reports of a drive-by shooting. The mother of one of the victims told police that her daughter and four other juveniles were walking to a nearby elementary school when they saw a car stop at a stop sign and several men wearing masks get out. The five victims began running towards surrounding homes, asking for someone to call 9-1-1. One of the victims identified Maciel as the only person to have fired a handgun at the group. He then left, before returning to fire more shots at the victims. Maciel stuck vehicles and residences in the area but did not strike anyone.

Deputy District Attorney Brett Dieffenbach argued for the aggregate sentence of 192 months as the maximum available under the law, given the extraordinary danger presented not only to minor victims but to the whole of a residential neighborhood in the early afternoon.

The Honorable Judge Lynne Jones presided and imposed the sentence.
